AGREEMENT of a public offer for the provision of transport services

1. GENERAL PROVISIONS

1.1. This document is an official offer of the company ATLANTA COMPANY individual entrepreneur Novogrodsky A.V. (Contractor) for individuals and legal entities to conclude an agreement for the provision of transport services on the conditions specified below and is published on the Internet at www.instagram.com/_atlanta_company_. The company is on the Register under number PL1251717865.

1.2. Individuals are understood as citizens, including entrepreneurs without forming a legal entity (hereinafter referred to as the Customer). For foreign citizens and legal entities, this agreement is valid without additional approvals.

1.3. This document is a public offer.

1.4. This public offer for the provision of transport services (hereinafter referred to as the Agreement) is concluded by accepting this Agreement, which contains all the essential terms of the agreement, without signing by the parties. This Agreement has legal force and is equivalent to the agreement signed by the parties.

1.5. This Agreement is considered concluded from the moment of its acceptance and is valid until the parties fulfill all their obligations under this Agreement.                       

1.6. ATLANTA COMPANY individual entrepreneur Novogrodsky A.V. on the one hand, and the visitor of the site www.instagram.com/_atlanta_company_ - an individual or legal entity - hereinafter referred to as the "Customer", on the other hand, have entered into this Agreement as follows:

2. SUBJECT OF THE CONTRACT

2.1. The Contractor assumes obligations for the provision of services for the transportation of pets in accordance with the terms of this agreement.

2.2. Services for transport services are carried out on the basis of this agreement and the Customer's applications, duly executed.

2.3. For the purposes of this agreement, transport services mean the services of the transport company ATLANTA COMPANY from the place of loading to the place of unloading along the routes and within the time agreed by the Parties. A vehicle means a minibus or airline services designed to transport animals in accordance with veterinary and customs requirements.

2.4. The terms of this Agreement are accepted by the Customer in full. Evidence of full and unconditional acceptance (acceptance) of the terms of this Agreement is the implementation by the Customer of the procedure for filling out an application for transportation.

3. RIGHTS AND OBLIGATIONS OF THE PARTIES

3.1. The customer is obliged:

3.1.1. Send the Contractor in writing information regarding the transported goods/cargo (live animal). The application must contain the following information:

- Date of service provision

- Animal type

- Animal breed

- Age of the animal

- Animal weight

-Departure point

-Destination

- A photocopy of the animal's veterinary passport

- A photocopy of the passport of the consignee

- Full address and mobile phone number of the consignee

- A photocopy of the passport of the consignor;

The application must be sent through the Contractor's website www.instagram.com/_atlanta_company_ or via social networks

Facebook/WhatsApp/Messenger, indicating all the parameters of the application. In the absence of any of the parameters of the application, confirmation of the booking is not guaranteed.

3.1.2. Use vehicles in accordance with the application. Any changes upon request, the Customer must agree with the Contractor. Changes in the Application must be agreed no later than 3 days preceding the date of commencement of the provision of services.

3.1.3. Make payment in accordance with Section 4 of this Agreement.

3.2. The customer has the right:

3.2.1. To cancel the application in whole or in part in accordance with the following rules:

- If the Application is canceled 5 days before the start of the provision of services, the Contractor withholds 10% (ten percent) of the cost of the service; - If the Application is canceled 3 days before the start of the provision of services, the Contractor withholds 50% (fifty percent) of the cost of the service; - When canceling the Application for 1 day or on the day of transport service, the Contractor withholds 100% (one hundred percent) of the cost of the service.

3.2.2. You can use additional services that are not specified at the stage of booking for an additional fee.

3.3. The contractor is obliged:

3.3.1. Consider the application, confirm or refuse the Customer.

3.3.2. Timely provide serviceable vehicles suitable for transporting animals in accordance with the Customer's Application.

3.3.3. Ensure compliance with all regulations applicable to the transport of live animals, incl. on road safety, sanitary and veterinary standards.

3.3.4. Ensure that the vehicle is replaced as soon as possible in the event of a technical malfunction. 3.4. The performer has the right:

3.4.1. For unilateral refusal to execute the contract, in case of receipt from the Customer of the Application for changes that the Contractor is not able to fulfill.

3.4.2. Involve third parties in the execution of the Customer's Application.

3.4.3. Confirm or refuse the Customer to perform the requested additional services.

4. COST OF SERVICES AND PROCEDURE OF PAYMENTS

4.1. The cost of transport services is set in accordance with the tariffs received by the Customer after sending the application for transportation. date of confirmation of the reservation, but no later than 7 days before the start of the trip (adjustments of the payment date are possible). In the absence of information regarding payment, the Contractor has the right to cancel the application.

4.2. Payment for the cost of transport services is made on the basis of an invoice for payment.

4.3. All payments are made in EURO.

5. RESPONSIBILITIES OF THE PARTIES

5.1. In case of damage to the inventory and equipment of the vehicle by a transported live animal, the Customer shall pay the Contractor compensation in proportion to the damage caused, as well as pay for the downtime of the vehicle necessary to eliminate the damage.

5.2. All disputes and disagreements that may arise during the execution of this Agreement or in connection with it will, if possible, be resolved through negotiations.

5.3. The contractor is responsible for the transported animal along the entire route.

5.4. The Contractor undertakes, when unloading the animal at the place of receipt (destination), to transfer the goods and the package of accompanying documentation to the recipient of the cargo: - Veterinary certificate for import into the EU;

- Veterinary passport of the animal;

- CHED-A border veterinary control certificate;

- Official animal health certificate for import pets.
